2.1. ARBO provides telemedicine services, health management, and other technological solutions.

2.2. The use of services is intended for lawful purposes only and in accordance with all applicable regulations.
 

3. User Registration and Account

3.1. To use certain services, you may need to create an account and provide accurate and complete information.

3.2. You are responsible for maintaining the confidentiality of your account credentials.
 

4. Use of Services

4.1. You agree not to use the services for any illegal or prohibited activity.

4.2. ARBO reserves the right to suspend or terminate access to the service for violations of these Terms.
 

5. Intellectual Property

All content and materials provided by ARBO are protected by copyright, trademarks, and other intellectual property laws. You may not copy, modify, or distribute any ARBO content without express permission.
 

6. Limitation of Liability

ARBO is not liable for direct, indirect, incidental, or consequential damages resulting from the use of our services.
 

7. Changes to the Terms

ARBO reserves the right to modify these Terms at any time. We recommend that you review the Terms regularly.
 

8. Consent

By registering with ARBO, you automatically agree to our Terms of Service.
 

Additional Information for Healthcare Professionals:

ARBO Health (“ARBO”) provides a platform to facilitate telehealth consultations between licensed healthcare professionals (“Providers”) and patients located across the United States. By using ARBO’s telehealth services, both Providers and patients (“Users”) agree to comply with all applicable federal and state laws governing telemedicine, telehealth, and the privacy and protection of patient information.

1. Provider Licensing and Compliance

Providers using ARBO must be properly licensed in the state where the patient is physically located at the time of the telemedicine consultation. ARBO verifies Provider licenses at the time of registration and reserves the right to periodically revalidate license status. Providers are responsible for maintaining valid licensure and ensuring that they are compliant with the specific telehealth laws of each state in which they  practice, including but not limited to:
 

  • Interstate Medical Licensure Compact (IMLC): Providers practicing across multiple states must comply with any applicable interstate licensure agreements, such as the IMLC, which allows streamlined licensure for telemedicine across participating states.

  • State-Specific Licensing Requirements: In states not participating in the IMLC or similar compacts, Providers must be licensed to practice in that specific state.


2. Telehealth Services and Limitations

Patients and Providers acknowledge that the availability of telemedicine services is subject to state-specific regulations regarding the delivery of healthcare via telehealth.
The following services and limitations apply:
 

  • Prescribing Medications: Providers may issue electronic prescriptions through ARBO, provided they comply with both federal law, including the Ryan Haight Act, and state-specific prescribing rules. Prescriptions for controlled substances may be restricted based on state regulations and federal law.

  • Audio-Only Consultations: Some states permit audio-only telemedicine services (e.g., phone consultations), while others require both audio and video communication. ARBO’s platform supports both, but Providers must ensure they are complying with the rules applicable in the state where the patient resides.

  • Mental Health and Behavioral Telemedicine: Certain states have expanded telemedicine services for mental and behavioral health. Providers offering these services must adhere to state-specific regulations regarding informed consent, licensure, and continuity of care.


3. Insurance Coverage and Payment Parity

Telehealth services provided through ARBO may be eligible for insurance reimbursement depending on the state’s parity laws. Many states require health insurers to reimburse telemedicine/telehealth services at the same rate as in-person visits (“payment parity”). Providers are responsible for verifying the specific insurance coverage and reimbursement policies applicable in their state. ARBO does not guarantee insurance coverage or reimbursement but facilitates the process for patients and Providers to engage in these discussions.

4. Patient Consent and Notification

Before a telemedicine/telehealth consultation begins, Providers must ensure that patients understand the nature of the service, including the risks and benefits, and that patients provide informed consent for treatment. Providers must document this consent in compliance with state law and retain it in the patient's medical records. Every patient registered with a profile at ARBO has agreed with this consent when they've signed up to the app.
 

  • Emergency Services: ARBO is not intended to provide emergency medical care. In the event of a medical emergency, patients must seek immediate assistance from emergency services (e.g., by dialing 911). Providers are encouraged to discuss emergency plans with patients during telemedicine/telehealth consultations and provide guidance on when to seek in-person care.


5. Privacy and Security of Health Information

ARBO complies with the Health Insurance Portability and Accountability Act (HIPAA) to protect the privacy and security of personal health information. All telemedicine/telehealth consultations conducted through ARBO’s platform are stored on cloud services that comply with HIPAA to ensure confidentiality and integrity of patient data. Providers and patients must ensure that they are using secure devices and networks when accessing the platform.
 

  • Protected Health Information (PHI): ARBO ensures the protection of PHI in accordance with HIPAA regulations. Providers are responsible for maintaining the confidentiality of PHI in their practice and ensuring that any transmission or storage of medical data is secure and compliant with HIPAA.


6. Telemedicine/Telehealth Laws and Regulations by State

Each state has its own set of laws governing telemedicine/telehealth, which may include requirements for provider licensure, types of services allowed, and patient consent procedures. By using ARBO’s telemedicine platform, Providers agree to abide by the laws of the state in which their patient is located, including but not limited to:
 

  • Licensure Requirements: Providers must be licensed or authorized to practice in the state where the patient is located at the time of the consultation.

  • Parental or Guardian Consent: For patients under the age of 18, state laws may require consent from a parent or legal guardian before a telemedicine consultation can occur.

  • Telemedicine Platform Usage: Some states prohibit exclusive arrangements between telemedicine platforms and providers. ARBO complies with these restrictions, allowing Providers the freedom to offer services across multiple platforms where permitted.


7. Compliance with Federal and State Laws

By agreeing to these Terms of Use, all Users acknowledge that they are acting in full compliance with applicable federal and state laws. Federal regulations, such as the Ryan Haight Act for prescribing controlled substances, must be followed by all Providers, regardless of state-specific laws. Additionally, Providers must adhere to the privacy standards outlined by HIPAA and any other relevant state privacy laws, such as California’s Consumer Privacy Act (CCPA).
 

  • Changes to Telemedicine Laws: Telemedicine/Telehealth regulations are constantly evolving. ARBO monitors changes to both federal and state laws and strives to keep Users informed of significant updates. Providers are responsible for staying informed of legal requirements that affect their practice.


8. Dispute Resolution and Governing Law

In the event of a dispute related to telemedicine/telehealth services provided through ARBO, Users agree to first seek resolution through ARBO’s internal dispute resolution process. If the dispute cannot be resolved internally, it will be governed by the laws of the state in which the patient resides at the time of the consultation, subject to applicable federal laws.

Acknowledgment and Acceptance

By using ARBO’s platform, you agree to the above terms and confirm that you are compliant with all applicable federal and state regulations governing telemedicine/telehealth. ARBO reserves the right to update these Terms of Use as telemedicine/telehealth laws evolve.
